Traffic Citations Information

If you choose to attend a Driving School, you MUST elect that first, prior to paying your citation. If you attend driving school prior to paying your citation, it will be an automatic adjudication of guilt and points will be assessed to your license. Review Option 2 (below) for more details.

Civil traffic infractions must be paid within 90 calendar days from the date the citation was issued. Failure to pay may result in a Driver License suspension and a reinstatement fee of $60. A late fee of $23 will be assessed to all unpaid traffic infractions.

Your options for a Traffic Citation

In Clay County, you have 90 days from the date of issuance to elect one of the following:

  • Option 1: Plead guilty, accept points on your driver license and pay the ticket
  • Option 2: Pay the ticket and Elect Traffic School to withhold adjudication off your driving record
  • Option 3: Contest the ticket and request a court hearing

Option 1 - Pay the Ticket

If you choose to pay the ticket, points are assessed against your driver license.
Pay Online, by mail, or in person.

Option 2 - Go To Traffic School

Driving school MUST be elected prior to paying your citation. You will have 90 days from the date traffic school is elected to complete the course and return the certificate to our office.

If you elect the Basic Driver Improvement Course option, adjudication is withheld and the DHSMV will not assess points against your driving record. A course certificate of completion form must be returned to the Clerk’s Office within the allotted timeframe to be accepted.

If you are electing traffic school you must submit a signed traffic school affidavit prior to taking the course.

Remember, you may only elect the traffic school option five (5) times in your life and the election can only be made once every twelve (12) months. Failure to timely complete the school course or timely submit your completion certificate or pay the fine will result in removal of the fee reduction, points being assessed, and suspension of your license and/or late fees being assessed.

Option 3 - Contesting Your Ticket

You must notify the Clerk of the Circuit Court and Comptroller within 90 days of the date the citation was issued to request a civil hearing to be scheduled.

The law enforcement officer that issued the citation will be present at your hearing as well as any witnesses listed by the officer.

If the Court finds you committed the offense, you may be ordered to pay a fine and/or attend a driver improvement school.
